Roberto Manno, acting as a Panelist before the ADR Center for .eu attached to the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic (Czech Arbitration Court), in spite of Complainant’s poor documentary evidences supporting alleged abusive registration of a domain name identical to its earlier rights (the “FIDUCIAIRE BELVAL” business name resulting from Luxembourg company register). Making use of Panellist’s discretional faculty to conduct independent investigations as per Paragraph B7(a) of the ADR Rules (including Web Archive searches), Roberto Manno concluded that Complaint was well-grounded ordering the trasfer of the domain name from Respondent.
